Welcome to Happyie! These Terms & Conditions ("Terms") govern your access to and use of the Happyie mobile application and services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.
1. Use of the Service
* Eligibility: You must be at least 18 years old to use the Service or have the permission and supervision of a parent or legal guardian.
* Account Creation: You must provide accurate, complete, and current information when creating an account. You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account.
* Acceptable Use: You agree to use the Service only for lawful purposes and in accordance with these Terms. You must not misuse the Service by knowingly introducing viruses, attempting to gain unauthorized access to our servers, or engaging in any activity that disrupts the Service.
2. Food Ordering and Delivery
* Contract of Sale: When you place an order through Happyie, you are entering into a direct contract with the Restaurant (the merchant) for the food items, and a contract with Happyie for the delivery service. Happyie acts as an agent to facilitate the transaction.
* Restaurant Responsibility: The Restaurant is responsible for the quality, safety, and preparation of the food and drinks. Happyie is not liable for the preparation of the meals or for any illness caused by food from a Restaurant.
* Pricing: All prices are listed by the Restaurants and are inclusive of applicable taxes, unless stated otherwise. Delivery fees, service charges, and small order fees may apply and will be clearly indicated before you complete your order.
* Order Cancellation: You may be able to cancel an order only if the Restaurant has not yet started preparing it. Once preparation has begun, cancellation may not be possible, and you may be charged the full amount.
3. Payments
* Payment Methods: Happyie accepts various payment methods, including credit/debit cards, net banking, and digital wallets.
* Payment Authorization: By placing an order, you authorize Happyie to charge the total order amount (including food, taxes, fees, and tips) to your chosen payment method.
* Tipping: Tips are optional and are passed directly to the Delivery Partner (rider), excluding any processing fees.
4. Intellectual Property
All intellectual property rights, including copyrights, trademarks, logos, and all content within the Happyie Service (except for user-generated content), belong to Happyie or its licensors. You may not use any Happyie trademarks or content without our prior written permission.
5. Limitation of Liability
* Happyie provides the service "as is." We do not guarantee that the service will be error-free or uninterrupted.
* To the maximum extent permitted by law, Happyie, its affiliates, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of the Service, including, but not limited to, damages for loss of profits, goodwill, data, or other intangible losses.
* Happyie’s total liability to you for any claim arising out of these Terms or your use of the Service shall not exceed the amount paid by you to Happyie in the last six (6) months preceding the claim.
6. Governing Law
These Terms shall be governed by and construed in accordance with the laws of [Insert Jurisdiction, e.g., India/Your State], without regard to its conflict of law provisions.
7. Changes to the Terms
